In fact, most short sales occur only after the Notice of Default has been filed by the lender.

Time savings as compared to foreclosure;

The fact that a short sale is a type of settlement as compared to a seizure of the property;

Negotiating a real estate short sale should be handled by a professional to ensure that the homeowner and/or buyer are represented fairly and presented with all of their rights throughout the process. Lending organizations are struggling at present and it is not their intention to offer anything more than they absolutely have to. Many people have homes and mortgages and have taken out a loan through a bank and or lender of their choice. Their job then is to make monthly payments to pay back the bank that lent them the money, what happens if one cannot make their payments? Making payments on the mortgage is above all the most important thing a homeowner can do. Not making your payments on time results in a lower credit rating making it tough to get a loan.

During this current recession, many people have lost their jobs making it impossible to pay their bills, currently; our unemployment rate is averaging around 10%. That means 10% of our population is currently out of work. When a person or family loses their income they cannot pay the bank back the money they borrowed, the bank will then start a foreclosure process that in a sense, takes the house back from the borrower.

There is help for foreclosures; the first step is to contact the lender. The lender will lie out all the options to keep the family from losing their homes as no one wants to lose their residence.

One option is to modify the terms of the loan, in other words lenders can reduce the payments by reducing the interest and or principal of the loan, other methods include modifying the payments for a longer period of time.

For example, a homeowner could extend the life of their loan, instead of paying off their home in 20 years; the loan is extended to be paid off in 30 years thus reducing the payments. Lowering payments gives the borrower longer time to pay off the loan with payments they can afford.

Another way to avoid foreclosure is to refinance the loan, which means extending and or reducing the interest rate into payments the borrower can afford. In some cases the loan can be transferred to another bank with lower payment plans. In other cases a loan modification can be arranged in which the loan is modified to terms the homeowner can live with. The government providing they can prove economic hardship upon the family by showing receipts, bank statements and W-2’s can also issue a loan modification.

When looking for foreclosure help, the first step is to talk to the lender and explain that you cannot make the payments, it is in the banks best interest to work with the borrower as foreclosure is an expensive and time consuming process.

There is help out there via the original lender or online, there are many companies online that offer credit consolidation of mortgages and they can be a resource rather than face foreclosure. It was never easy for us but in the last year it became really hard. After a few months of financial problems, we realized that we have to change something because otherwise we will lose our house. We reviewed out budget and we tried to buy only those things which were necessary. Still after two months we couldn’t pay our mortgage anymore. In that time we didn’t even know exactly what is short sale and how to short sale your home, but we were afraid of foreclosure.

I looked on the internet to find out more about foreclosure stop and also looked for foreclosure help. We were all panicked because we didn’t want to lose everything that we’ve been working for so long. After reading many articles I found some very relevant information about short sale and pre-foreclosure. Apparently we still had some chance of short sale of home mortgage. We also hoped we can avoid foreclosure, which is the worst thing that can happen to a family like us. I also found the website of a great company that helps stop foreclosure and makes sure that you can short sale the house before anything else happens.

I called the number on their website and told them our situation. I told them that we need a prevention of home foreclosure and that we would like to know our options. They were very helpful and we had a long discussion. They have a lot of experience in the foreclosure process and short sale process as well. They evaluated our situation and the value of our home, and they said that we still have the chance for home short sale. We were so happy to hear that, because we were already dreading the though of a notice of foreclosure that was probably what would have happened if I don’t contact this company.
Since the staff of the company knows all the buyers and sellers in the area, they asked me if I want to sell my house right away and I immediately agreed. Normally it takes some time to sell a house but with their help and short sale representation we sold the house in Orange county very fast. I’m so glad that I started to look for short sale help that day, because if I didn’t we would probably be on the streets by now. We had to move to a smaller apartment after the short sale for a few months, but we were happy that things didn’t turn out so bad after all. We even got some short sale credit and we decided that we will take more care of our finances in the future.

A loan modification is something you may apply for if you are facing foreclosure. It is a change in the terms of a loan, usually the interest rate, payment or term; making the payment more affordable for you and helping avoid foreclosure. There are certain steps you need to take and things to consider before applying for a loan modification. Read on to learn more about how loan modification can help stop foreclosure.

First keep in mind the goal of a loan modification is to make it easier for you to make your mortgage payments, keeping you out of foreclosure. Many bank lenders will be happy to look into loan modification options for you, since they want to avoid foreclosure, just as much as you do. But getting a loan modification, can be a process and there are certain things you need to watch out for and to protect yourself from scammers.

Unfortunately there are people out there that want to take advantage of you in your time of need and may try to scam money out of you. These people are using the good intentions of your loan modification for their own personal gains. Make sure you do your research before you work with a loan modification company. Look online for reviews about them, make sure previous clients have been satisfied with them and they don’t have any negative comments to say. Or at least make sure they have more good reviews than bad. Not everyone can be helped in these situations and sometimes people may be upset because they couldn’t save their home. It’s not uncommon for these people to give bad reviews, even when they may have been given a refund for any money they spent. Most reputable companies have an refund policy when they are not successful, but make sure they will stand behind their guarantee.

There are certain key things you can look for to tell if a company may be fraudulent. First off fraudulent foreclosure help organizations will usually promise to take care of all your problems with your lender and obtain refinancing for you. They may even ask you to make mortgage payments directly to them. This will likely be money you will never see again and probably isn’t going toward your mortgage pay off. When someone asks you to start making your mortgage payments to them, run away as fast as possible!

Some “help” organizations may even ask you for the property deed, saying that if you make the payments to them, you can stay in your home. What usually happens is that the scammer takes all the money and sometimes they will even file a bankruptcy case in your name. This is because bankruptcy filing can stop a home foreclosure, usually for just a temporary period of time though.

If a scammer files a bankruptcy in your name and you do not participate in the case, the judge will dismiss it and the foreclosure proceedings will continue. This is one of the worse case scenarios because you will loose all the money you gave to the con artist and you will have bankruptcy on your credit records.

Another thing to watch out for is loan modification companies that say they are attorney based or backed. A loan modifciation attorney should be the one doing a loan modification and being backed by one is usually just a play on words and doesn’t mean a thing. So if a company says we have attorneys that back us, that may mean nothing at all. Maybe the guy that works there has a friend as attorney for all you know. This is why it is important to do some digging on your own before working with a company or handing them over any money. Usually when you ask to know who the attorney is, or ask for professional credentials, they will have some excuse not to give you names or license numbers.

You should always work with a loan modification company that have a refund policy, either a partial or full amount will be returned to you, if they don’t do what they promise. Make sure if a company tells you this, you get it in writing and keep the documentation. Also never sign any papers that they send, unless you understand every single word on them. One company we refer people to even offers a refund where they will pay you an additional amount if they don’t get the new payment they promised! This is one of the best gurantees we’ve seen.

Your ultimate goal is to save your home, so do the research and talk to the right people. A loan modification company or attorney may be a good first step. Most of them provide a free consolation, to start with. Most attorneys, although expensive, will be legitimate and can provide you will a good service. Never hesitate to ask questions though if you have concerns and walk away if something feels just not right with a company, it could just save your home.

It’s easy to feel helpless when the bank is foreclosing on your home, but it does not have to be that way. There are things that can be done during foreclosure proceedings to convince the bank to allow you keep your home. You should work with your lender if you are behind on your mortgage and the sooner the better. It is possible as many people are learning everyday!

If You’re screening your calls and worried about what you’re going to do if the bank does take your home you need to realize that time is still on your side but you have to act now to fix your situation. It is going to get really ugly as the bank starts the legal process to take back your home. You should understand that the bank would really rather not foreclose. Not because they are feeling sorry for you or they are worried about the kids, it really is a matter of them not wanting to carry your home on their books but again you won’t know until you take action to prevent this from happening. Stopping your foreclosure is possible and will depend on your specific circumstances but just know that you do have choices and you don’t have to lose your most important investment.

Again, the bank doesn’t want to take your home. Your lender doesn’t need a place to live. But you didn’t make your mortgage payments so the bank is in a spot and their investment has to be protected. The bank doesn’t want to kick you out of your house anymore than you want to lose it. Money is the key motivator here, so that’s where you need to start to help yourself get out of this foreclosure.

To help avoid foreclosure, you can try to negotiate a payment plan or work with your lender to lower your interest rate. Don’t screen your calls and avoid your lender’s letters! Foreclosure is the situation when a property owner cannot make the payments to the principal loan or even to the interest of the principal loan. The inability to pay leads to the property being seized and sold. That is foreclosure of property. There are basically 4 major steps in the foreclosure process. The first stage is the ‘notice to accelerate’. This notice is sent to the home owner who is 60 days past due to a payment. Even after missing a monthly payment for the first time, you can be assured that the lender will contact you about your status.

After the second month of inability to pay, the lender will contact you again and inquire about your status, and at this point t is most advisable to speak to the lender and explain your situation or you may get a counselor to assist at this early stage. Once you reach the point that you’re 60 days past due in payment, it is most important to update your payment along with the additional late fees that may be assessed. The second stage is the sending of the demand letter. The formal demand letter is made by the attorney that is hired by the lender. It is a formal notification that the foreclosure process will start if updated payments will not be made.

‘Notice of default’ is the third stage where the formal foreclosure notice is sent to court and filed. Twenty to thirty days is given for you to respond before the foreclosure process moves forward. And in the notice of default is the list of the amount you need to settle in its entirety. The fourth and final stage is the ‘notice of sale’, where the sheriff is to set an auction date. At this point, the property that is foreclosed will be sold at auction.

In order to avoid this process, it is essential to keep in constant communication with the lender or the bank to establish that you are finding ways in order to settle the payments. In some cases, partial payments are accepted until current status is updated. It is best to find a good foreclosure help consultant that can help you avoid the foreclosure process and save the home early on.
