Foreclosure is the situation when a property owner cannot make the payments to the principal loan or even to the interest of the principal loan. The inability to pay leads to the property being seized and sold. That is foreclosure of property. There are basically 4 major steps in the foreclosure process. The first stage is the ‘notice to accelerate’. This notice is sent to the home owner who is 60 days past due to a payment. Even after missing a monthly payment for the first time, you can be assured that the lender will contact you about your status.

After the second month of inability to pay, the lender will contact you again and inquire about your status, and at this point t is most advisable to speak to the lender and explain your situation or you may get a counselor to assist at this early stage. Once you reach the point that you’re 60 days past due in payment, it is most important to update your payment along with the additional late fees that may be assessed. The second stage is the sending of the demand letter. The formal demand letter is made by the attorney that is hired by the lender. It is a formal notification that the foreclosure process will start if updated payments will not be made.

‘Notice of default’ is the third stage where the formal foreclosure notice is sent to court and filed. Twenty to thirty days is given for you to respond before the foreclosure process moves forward. And in the notice of default is the list of the amount you need to settle in its entirety. The fourth and final stage is the ‘notice of sale’, where the sheriff is to set an auction date. At this point, the property that is foreclosed will be sold at auction.

In order to avoid this process, it is essential to keep in constant communication with the lender or the bank to establish that you are finding ways in order to settle the payments. In some cases, partial payments are accepted until current status is updated. When we were little, we’ve always been told how prevention works better than cure. The same holds true when it comes to home foreclosure. Lawyers, counselors and personal finance experts would tell you that avoiding home foreclosure is easier than stopping one that’s waiting to happen. So much has been said about what you should do to avoid home foreclosure. Now here are some of the things that you should remember not to do to keep your home.

First, do not forget to save for the rainy days. This definitely is easier said than done. But think about every dollar that you earn and where they go. This way, you can identify the expenses that are not essential and that you can do away with. These days, every dollar counts, especially when we’re talking about losing your home. Set up a mortgage fund where every excess dollar should go.

Second, do not fail to pay your monthly mortgage dues. We don’t need to say this, but for emphasis, remember that every foreclosure sale has its roots in one missed payment. If you think you can skip your home mortgage payment for this month, consider this: failure to pay your mortgage dues has more adverse consequences than failing to pay your cable, electric or credit card payment. These adverse consequences include: a deteriorating credit rating, which will cause you to have trouble securing emergency loans, and a psychological assurance that non-payment of the succeeding dues will be okay.
Third, do not hesitate to seek help. Help can come in the form of home foreclosure counselors who can give you expert advice on your options, or friends and family members who can pitch in so you can get by this month’s payment.

Fourth, do not disregard your creditor’s communications and notices. There is no reason to be afraid of talking to your lender. The truth is, creditors prefer to hear you explain why you are having difficulty meeting your obligation and what you are doing to remedy the situation. Not picking up their calls or responding to their emails will not make the problem go away, but will only accelerate the foreclosure time frame.

Fifth, do not be in denial. The sooner you accept the fact that you are in dire straits, the sooner you can start looking for a solution. How soon should you accept? As soon as you foresee that you won’t earn enough to pay all your bills.

Sixth, do not think of this as a hopeless situation. There is a big difference between acceptance and resignation. Accept the fact that there is a problem that needs solutions, but do not resign yourself to the idea that you are doomed and that you will lose your home soon. There are many remedies and options that are available to prevent foreclosure, you only need to look around, ask the right people, and be determined to see this problem through.

Seventh, do not prioritize other bills. If you have money, then that money should go to your home mortgage debt, after essentials such as healthcare and food, of course. Credit card debts and other unsecured loans can be paid off when you start earning more, if that’s the only thing that you should remember.

A Short Sale Can Stop Home Foreclosure & Save Your Credit


Nothing is as detrimental to your credit rating as late mortgage payments and foreclosures. If you have fallen behind on your mortgage payments and are facing home foreclosure, you should consider using a short sale to sell your home now and avoid foreclosure.


One of the most common questions that homeowners ask is, “can I still sell my home if I am in foreclosure?” A Short Sale is simply selling your property for less than what is owed with the permission of your mortgage lender. It is not as complicated as many foreclosure advice experts make it sound, and is one of the best forms of foreclosure help available. There are three steps to closing a short sale: short sale pre-qualification, marketing the property, and closing the short sale.


The first step, short sale pre-qualification, is when you contact your lender and explain that your financial situation has changed and you wish to avoid foreclosure by selling your home. Most lenders have a short sale application that can be faxed or emailed. The application will tell you what documents you will need to gather and submit to your lender in order for them to determine if a short sale is an option. Common documents include paycheck stubs, tax returns, hardship letter, and bank statements. These items show your lender that you are not in a position to repay the loan.


Once your file has been pre-qualified for a short sale, you will market the property to find a qualified buyer. This means hiring a realtor and, if you can afford it, advertising your property in your local newspaper or other real estate publications. Remember, you are not trying to profit from the sale or cover what is owed to your lender. You are simply trying to stop home foreclosure and avoid have a foreclosure on your credit history by helping your lender recover as much of the money they loaned you as possible. It is also important to remember that the foreclosure process can be quite lengthy in some states, so don’t give up using a short sale to avoid foreclosure just because you do not find a buyer immediately.


Lastly, once you have found a qualified buyer, you will submit your purchase contract and the buyer’s credentials (pre-approval letter or proof of funds to close) to your lender. If your lender accepts the offer, then the deal is sent to a title company who will facilitate the closing of escrow. It is also important to order any city of point of sale inspections or other inspections as to avoid delaying your buyer from closing on time.


Once you have completed these steps, you will have stopped home foreclosure and your credit rating will be much better, in most cases, than if you had simply done nothing and lost your home through the foreclosure process. A short sale is a great option to anyone trying to avoid foreclosure.

If you are in danger of facing foreclosure because you have defaulted on your monthly mortgage payments, you must act quickly before it’s too late to negotiate a loan modification, and your home gets sold in a foreclosure auction. You may feel hopeless now, but there is still hope until that auction date arrives. Here are a few tips to help save your home from foreclosure.

During foreclosure proceedings, do not move out of your house so that you can still claim benefits such as, one-time FHA mortgage insurance, etc. Mark your mortgage due date in red and prioritize you’re most important financial obligations accordingly. Make a list of all your monthly payments. Your monthly mortgage payment must be on top of the list. Credit card bills, personal loans and other unsecured debts will have to suffer and go down the lists for the meantime while you catch up on your mortgage payments. Besides damaging your credit score, these debts will not bring greater consequences compared to loosing your home to foreclosure. The effects foreclosure has on your credit score are MUCH more severe anyway. Do not ignore nor wait for your banks foreclosure notice. Inform them beforehand that you are in a financial crisis because of a hardship. This act of good-faith could earn a bit of mercy from your lender. Provide necessary supporting loan modification documents for their assessment. In all likelihood, your lender might either extend the grace period or consider a forbearance agreement just as long as you make the effort to catch up with your mortgage payments. Seek the help of credit counseling and debt management program. You can repair you own credit by downloading our free credit repair kit. Take advantage of lenders and local housing agencies or extension services offering these programs especially if it’s for free. The best venue to seek free financial and foreclosure help from is the U.S. Department of Housing and Urban Development (HUD), as there are lists of credit counseling and debt management agencies approved to work with HUD loans and possibly with your lender. In cases involving promissory notes or predatory lending, contact your bank directly. Consider the options to get affordable mortgage payments. It could be by restructuring or refinancing your mortgage loan. With the new Obama loan modification programs currently available, deciding what to choose would be easy depending on your financial capacity. Keep in mind that mortgage refinancing costs can be expensive because of the processing fees, such as closing costs and points. If you’re successful in negotiating a lower monthly mortgage payment, get the resolution in writing. In fact, keep all loan modification documents that legally represent any agreement or arrangement with your lender If not, sell unnecessary assets. You can raise money by doing this and pay your mortgage until you recover from your financial hardship. It is also a good time to lower your monthly expenses. But doing both of these will not be enough in the long run if your financial situation is remains the same. You can sell your home to a third party as an alternative. This could be referred to as short sale. Sometimes creditors accept this as full settlement of the debt. Typically though, the selling value of the house cannot cover the outstanding loan balance, so some banks would rob you through foreclosure deficiency if you have too many assets. Get the help of housing counselor, real estate agent or a loan modification lawyer. You may also be able to re-purchase your property after the foreclosure auction. Negotiate a forbearance agreement. As much as you want to keep your house, is as much as the lenders want to get paid. In the case of forbearance, your lender will temporarily stop foreclosure proceedings until another payment option can be executed. Declare bankruptcy. This could put your credit record in a bad spot. Remember that you may or may not be able to keep your home with this option. If you seriously think that this is your only way out, call your attorney to discuss what to do. Turn-over your home to your lender. This is called “deed in lieu of foreclosure.” This option will not affect your credit score but you will be rendered homeless. As you are making things easier for the lender, this act may just be recognized thru eliminating your loan balance even if the house sells less. Again, get the help of a mortgage attorney.

Be realistic in choosing your options because once an agreement is reached you must conform, otherwise you’ll surely face another foreclosure.

The majority of mortgages are secured or funded by government programs such as HUD, FHA, or VA. If your mortgage belongs to any of these agencies, inquire about what options they offer to save your home. But you must approach your lender first to personally negotiate openly and honestly. In doing so you’ll save paying credit counseling agencies or lawyers.

Stopping a foreclosure is easier than you might think but, let’s first get an understanding of why it’s possible to stop foreclosure.

The biggest factor working on the side of the homeowner is that lenders don’t want to foreclose on homes because mortgage companies aren’t in the business of owning real estate.

Did you know?

· With legal fees, taxes and holding cost, it cost the lender ,000-,000 on average just to foreclose on one home?

· Chances are, your lender doesn’t even own your mortgage anymore

· Most mortgage companies sell your mortgage soon after it closes

That’s just a few of reasons why banks are willing to accept a work out arrangement instead of foreclosing on your home.

Lenders are willing to grant one a one-time forbearance (an agreement not to foreclose) or loan reinstatement under certain circumstances. You must have experienced a hardship. Which would include loss of income, job loss etc. (see list of hardships on page 5) they also need to know that the hardship is over and that you can resume making your monthly payments.

So, it is very important that your lender understand that you have a legitimate reason for why you didn’t make your monthly payments. That’s why they require w2’s and checks stubs to verify that you had a loss in income.

If you predict that you will not be able to afford your mortgage payments in the future, there are other options that your lender may be willing to grant you such as deed in lieu and a short sale. Both of these options will prevent foreclosure, but neither allows you to keep your home.

Having a foreclosure on your credit report subtracts about 150 points from your fico score and you probably won’t be able to get another mortgage for at least 2 years. So, if you can avoid foreclosure, then by all means do so.

Lastly, your chances of obtaining a workout plan will be greatly increased if you can come up with about 25-30% of the past due amount to offer the lender. This will help you bring your mortgage current faster, and lenders like that. This will also lower the monthly payment of your repayment plan.
